These terms are an agreement between you and MuscleBid ("MuscleBid", "we", "us"). By creating an account, connecting eBay, making a purchase or using the site, you agree to them. If you don't agree, please don't use MuscleBid.

1. The service

MuscleBid lets you schedule a bid on an eBay auction to be placed for you shortly before the auction ends (a "snipe"). Bids are placed through eBay's official APIs using the access you grant when you connect your eBay account. We never ask for or store your eBay password.

MuscleBid is an independent service. It is not owned by, affiliated with, or endorsed by eBay Inc. eBay is a trademark of eBay Inc.

You must be at least 18 and hold an eBay account in good standing to use MuscleBid.

2. Your bids are your responsibility

Every snipe is a real bid placed in your name. If it wins, you have entered a binding contract to buy the item from the seller under eBay's rules, exactly as if you had bid yourself.
You are responsible for choosing the item, checking the listing, setting your maximum bid, and paying for and receiving anything you win. Double-check your max bid before saving. We place the amount you enter.
You must follow eBay's User Agreement and policies. If you want to cancel a snipe, do it before it fires; a bid that has been placed can only be retracted under eBay's own rules.

3. No guarantee that a snipe is placed or wins

We work hard to place every snipe on time, but we can't promise it. A snipe may fail, be late, or lose because of things like: eBay outages, errors or rate limits; changes to eBay's APIs; the listing being changed, ended early or removed; your eBay account being restricted or your connection to MuscleBid expiring; internet or hosting problems; someone else bidding more; or a bug in our software. MuscleBid is not responsible for any snipe that is not placed, is placed late, or does not win, or for any loss that results.

4. Purchases and refunds

MuscleBid is a one-time purchase ($30, or $20 with an affiliate promo code). It gives your account access for as long as MuscleBid operates the service. There is no subscription. It does not guarantee the service will run forever.
New accounts may get a free trial (currently, snipes until your first win). We can change or end the free trial at any time.
No refund will be given if eBay, or any other company or authority that MuscleBid or you rely on, restricts, suspends, changes or ends access to its platform, API or services. That includes, for example, eBay limiting or revoking MuscleBid's API access, eBay restricting or suspending your eBay account, or eBay changing its rules so that some or all snipes can no longer be placed. It also includes our payment, hosting or infrastructure providers restricting their services to us.
No refund will be given if your account is suspended or closed for misuse (section 5) or for attempting to break into or tamper with MuscleBid (section 6).
Otherwise, refunds are at our discretion. Email michaelmessina37@gmail.com within 14 days of purchase if something went wrong. A refund ends your paid access.
If you file a chargeback or payment dispute instead of contacting us, we may suspend your account while it is resolved. A chargeback found to be unjustified counts as misuse.

5. Acceptable use

You agree not to misuse MuscleBid. Misuse includes, for example:

Shill bidding, bidding on your own listings, or any other bid manipulation;
Using MuscleBid in a way that breaks eBay's User Agreement or policies, or the law;
Placing bids you don't intend to pay for;
Creating multiple accounts to get extra free trials or promo discounts;
Sharing, selling or renting your account, or using someone else's eBay account without permission;
Using bots, scripts or scrapers against MuscleBid, or putting an unreasonable load on it;
Paying with a card or account you aren't authorized to use, or chargeback fraud.

If we believe you have misused MuscleBid, we may suspend or close your account, cancel your scheduled snipes, and block you from using MuscleBid again, without a refund.

6. Security: attempts to break in

You may not attempt to gain unauthorized access to MuscleBid, its servers, databases or other users' accounts. That includes probing or scanning for vulnerabilities, exploiting bugs, guessing or stuffing passwords, bypassing payment or the free-trial limits, tampering with requests, or interfering with bids.

Any attempt to break into or tamper with MuscleBid will result in immediate, permanent blacklisting with no refund. Blacklisting can cover your MuscleBid accounts, email addresses, eBay accounts and payment methods. We may keep records of the attempt and report it to the appropriate authorities.

If you come across a security issue by accident, please email michaelmessina37@gmail.com and don't use it. Good-faith reports made that way are welcome and don't violate this section.

7. Your eBay connection

You can disconnect eBay at any time, from MuscleBid or from your eBay account settings. Disconnecting stops any snipes that haven't fired. eBay authorizations expire periodically and you may need to reconnect; snipes can't be placed while you're disconnected.

8. Affiliate program

Affiliates are approved at our discretion. Approved affiliates get free access to MuscleBid while they remain affiliates, and earn $15 for each purchase made with their promo code.
Commission on each sale is paid after a 30-day wait, with no minimum balance, to the payout account you give us. Sales that are refunded or disputed earn no commission; if one was already paid, it is deducted from future payouts.
Affiliates are independent, not employees or agents of MuscleBid, and are responsible for their own taxes. We may ask for tax information (such as a W-9) before paying.
No self-referrals, spam, fake reviews, misleading claims (including saying MuscleBid is part of or endorsed by eBay), or bidding on "MuscleBid" in search ads. Breaking these rules forfeits unpaid commission and ends the affiliate's code and free access. We may change or end the affiliate program at any time; commission already earned under these rules will still be paid.

9. Closing your account

You can stop using MuscleBid at any time; email michaelmessina37@gmail.com to have your account deleted. We may suspend or end the service, or your access to it, at any time, including under sections 4 to 6. If we shut MuscleBid down entirely, we'll try to give reasonable notice on the site.

10. Disclaimer and limitation of liability

MuscleBid is provided "as is" and "as available", without warranties of any kind, including any warranty that it will be uninterrupted or error-free, or that any snipe will be placed or win. To the fullest extent the law allows, MuscleBid will not be liable for any indirect, incidental, special or consequential damages, or for lost items, lost bids, lost profits or overpayments. Our total liability for any claim is limited to the amount you paid MuscleBid.

You agree to indemnify MuscleBid against claims arising from your bids, your use of the service in breach of these terms, or your breach of eBay's rules.

Nothing in these terms limits any rights you have under consumer protection laws that can't legally be waived.

11. Changes

We may update these terms. The date at the top shows the latest version. If a change is significant we'll point it out on the site. Continuing to use MuscleBid after a change means you accept the updated terms.
